1.Data Controller

1.1 The data controller is CUIMAR, with its registered office located at CUIRMER SARL (Currently being transformed into CUIMAR SAS), 46 BD Zerktouni, 2nd floor, apartment no. 6. In this capacity, CUIMAR – and/or its service providers acting on its behalf – determines the purposes, technical and legal means for processing personal data and commits to taking all necessary organizational measures to ensure safe processing in compliance with Moroccan Law No. 09-08 relating to the protection of individuals regarding the processing of personal data.

1.2. CUIMAR is free to choose any individual or entity that processes the personal data of Users at its request and on its behalf (hereinafter referred to as “the subcontractor”). If necessary, CUIMAR commits to selecting a subcontractor that provides sufficient guarantees regarding the technical and organizational security measures for processing personal data.

2.Processing of Personal Data

2.1. The use of the Site, access to certain sections, and/or any request for information or services from Users may result in the communication of personal data. The processing of this data by CUIMAR, in its capacity as Data Controller, and/or by the providers acting on behalf of CUIMAR, will be in accordance with Law No. 09-08.

2.2. This privacy policy is designed to inform Users, even before accessing the various sections of the Site and communicating their personal data, about how CUIMAR processes the personal data of Users on the Site. The User must necessarily acknowledge this policy before providing their personal data by filling out the forms provided for this purpose in the various sections of the Site.

2.3. Personal data will primarily be processed automatically, with procedures strictly linked to the purposes outlined in section 3.

CUIMAR ensures that Users’ personal data is processed securely and confidentially and takes adequate measures to prevent loss, misuse, alteration, and deletion of this personal data.

2.4. CUIMAR also collects certain personal data from Users to recognize them and offer an optimal, quality, and personalized user experience. This collection also allows for the correction of any errors on the Site. The information collected includes User connection data (IP address, geographical area, date and time of consultation, services viewed and/or used, etc.) as well as the device used to connect.

2.5 The Site uses cookies to better meet the needs of Users and personalize their experience. The purpose of the cookie is to signal your visit to the Site.
2.6. Any failure to provide complete or accurate personal data, marked with an asterisk and necessary for the execution of the requested service, renders this impossible. Conversely, any failure to provide optional personal data is without consequence.

3.Purposes of Processing Personal Data

The personal data of Users is processed to facilitate the processing and delivery of orders placed on the Site. The ordering process on the website www.cuimarleather.com requires the creation of a Client account in which their information is stored and protected by a password chosen by the Client.

Subject to validation by a “client opt-in,” personal information (personal data, email address, gender, etc.) may also be used by CUIMAR and/or its partners for commercial purposes such as sending newsletters or solicitations.

4.Personal Data That May Be Processed

The information Users provide when filling out forms or creating their client account is collected and processed. This information may include the User’s name, gender, size, address, email address, and phone number.

5.Consent

The User has the right to withdraw their consent at any time. The withdrawal of consent does not affect the legality of the processing already carried out based on the consent given before the withdrawal. This right can be exercised electronically at the following address: info@cuimarleather.com.

6.Duration of Personal Data Retention

In accordance with the legal requirements imposed by the Law, CUIMAR retains Users’ personal data only for as long as reasonably necessary to fulfill the purposes for which it is processed.

7.Communication of Users' Personal Data for Internal Purposes

7.1. Personal data may be transmitted to employees or collaborators of CUIMAR who, operating under the direct authority of CUIMAR, are designated as data controllers or subcontractors of this data and receive appropriate operational instructions. Personal data may also be disclosed to employees or collaborators of the data controllers if they, appointed by CUIMAR, decide so and provided that this data is processed in accordance with the pursued purposes.

7.2. CUIMAR ensures that subcontractors, employees, or collaborators provide the same level of protection as itself and ensures that these subcontractors, employees, or collaborators process personal data solely for the purposes authorized by the pursued objectives, with the necessary discretion and security.

7.3. Personal data directly communicated by Users through online forms may be communicated and processed by external service providers acting on behalf and for the account of CUIMAR.

8.Users' Rights

8.1. CUIMAR guarantees fair and lawful processing of Users’ personal data.

8.2. CUIMAR guarantees Users the right to access their personal data.

According to the law, the User has the right to obtain from www.cuimarleather.com the following information (but not limited to):

  1. The purposes of the processing;
  2. The categories of personal data concerned;
  3. The recipients or categories of recipients to whomthe personal data has been or will be communicated, particularly recipients established in third countries or international organizations;
  4. Where possible, the anticipated duration of the retention of personal data, or, where not possible, the criteria used to determine this duration;

8.4.CUIMAR guarantees the right to limit processing.

The User has the right to obtain the limitation of the processing of their personal data.

8.5. CUIMAR guarantees the right to object to data processing.The User has the right to object at any time to the processing of their personal data when there are compelling and legitimate reasons relating to their particular situation. In this case, CUIMAR will no longer process the personal data unless there are legitimate and compelling reasons for the processing that prevail over the interests and rights and freedoms of the User, or for the establishment, exercise, or defense of legal rights.

8.7. CUIMAR guarantees the right to lodge a complaint. The User has the right to lodge a complaint regarding the processing of their personal data by CUIMAR with the National Commission for the Protection of Personal Data.

9.Limitation of Liability of the Data Controller

The Site may contain hyperlinks to websites controlled and operated by third parties not related to CUIMAR. In this case, CUIMAR cannot be held responsible for the content of these sites, nor for the personal data protection practices of these third parties.

CUIMAR cannot be held responsible for loss, corruption of data, or identity theft, which may be caused by the presence of viruses or cyber attacks.
